Federal Judge Orders Release of Kilmar Abrego Garcia from Immigration Custody
A federal judge has ruled the immediate release of Kilmar Abrego Garcia from detention by ICE, finding his continued detainment lacks legal authority.
"Since Abrego Garcia's release after wrongful detention in El Salvador, he has been taken back into custody, again without legal justification," the judge wrote in her ruling.
The situation stems from a erroneous deportation to El Salvador earlier this year, which the government later admitted was an error. After his repatriation to the United States to answer human smuggling allegations, he was held in federal detention.
In her decision, the court pointed out that the government does not have a current removal order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."
